Touchy, Touchy, Touchy
Last week I went on line to the Shawnee Dispatch to download the questionnaires that the individuals running for council answered, prior to the election. Figured that since we had 3 new members this time, that later, after about 6 months, it would be neat to look at their campaiogn comments and then compare those to what had actually happened.
Well, one item popped up regarding Jeff Vaught. As a matter of fact, I had seen it before the election, meant to ask about it, and actually forgot. Could not believe that such an innocuous item could raise such a fury. Follow the exchange of emails.

Why? Simple................because you made it an item of curiosity by stating "no comment" My first email is a little more specific.
What ward I live in is immaterial. As an elected member of the city council, any citizen of Shawnee can ask you that question. Ward 3 residents vote for or against you. But when you are on the council you represent all citizens of the city. Very similar to the Congress of the United States. If I have a question for a Rep or Senator, regardless of where they are from, I can and will ask it. Just like any citizen of Shawnee has the right to voice their opinion to any member of the council, regardless of their ward. This would include, but not necessarily be limited to any opinions as to what actions they would like the council member to either approve or disapprove.
So, the choice is yours. You can either answer the question or you can refuse to answer it. We don't have to go back and forth with it. Just let me know which one.

Guess that is a touchy subject. No reply as of last night. Guess he also doesn't realize that eventhough the voters of the 3d Ward elected him, that when he sits on the council he represents everybody and anybody can question him. Why is that such a touchy question?
As a side note: Why don't residents of Ward 3 question some things? See the post below about apathy. When it comes to local elections, Ward 3 is the most apathetic. Does that have anything to do with it?

Apathy In Shawnee
Believe there have been various posts about this in the past on this blog.
I decided to share some statistical information with those who do read it. It is amazing though how the elected body that has the greatest effect on our daily lives draws the absolute smallest response on election day. At a presidential election the turnout is pretty good...........but the president, congress etc does not have the effect on us daily that the city does. It's the city that sets property taxes, local sales taxes, provides public safety services, public infrastructure services etc etc................don't think I've ever seen a congressman, senator or president shoveling/plowing snow or laying asphalt, responding to a domestic violence situation, putting out a fire, or rushing a heart attack victim to the hospital.
Here are the figures:

Another response, re: TIF
Now, this sounds good, especially the last part:
Mike, you are correct in every assumption. Without a tiff, this property will be sold for either a high density housing development or perhaps we’d rather see large (2-5 acre) plots with upper level homes. Either way, the highest and best use of the ground would be a high end development which welcomes consumers to Shawnee. It is truly large enough to attract a theme park or some other single user, such as Disney proposed some years ago for a music themed entertainment. More likely, the TIFF would allow a developer to give a beautiful, well planned mix of retail/entertainment, office, high end living spaces all similar to development around the race track at the Legends.

A Response to what is a TIF?

this corner, when developed, will be our "gateway" development to more development westbound on shawnee mission parkway, all the way out to shawnee mission pkwy. and kansas hiway 7.
if you have ever been on the property ( i have ) you would notice that like the deffenbaugh rock mining + landfill operation, it is a huge pile of rock under that soil.
to make it "development ready", it will take millions of dollars of rock detonation, earth moving, and utility installation.
in short, it is a "big deal." despite the fact that the families involved have a net worth exceeding you + i, it is still a huge endeavor, and one that cannot be undertaken without a city / landowner / developer partnership. the other alternative is to leave it alone, zoned agricultural, which produces the lowest revenue stream possible, or the owners bequeath it to a charitable-trust estate arrangement, and tax revenue could go to zero.
from a personal standpoint, i would love to see a drury inn, mixed retail / condo development / restaurant / bar area, similar to a development that i am familiar with in west des moines, iowa, that has spurred further development along a similar corridor, and is now one the current "hot properties" in polk county, ia.
i understand your concern on t.i.f., and to be sure, all t.i.f.'s are not created equal. in this case, i believe that the "give to get" scenario of this property is in the best long term interest of shawnee and the school districts.
another key consideration is that when cerner corp. builds the development out by the nascar track, the need for affordable, condo-type housing in west shawnee plays right into this future potential area. some clerical worker and her husband working at cerner can afford a nice, new, $100,000.00 - $150,000.00 2 br. condo, in an area with restaurants / bars / retail, but cannot afford to buy my home at a $250,000.00 clip.
ray, i hope that you take my commentary at face value, as i have no financial dog in this hunt, just want to see first class future development out here in my neighborhood.

What's in a TIF?
Last week, the city council approved a TIF (tax increment financing district) for an area (approximately 240 acres) in the vicinity of I-435, Johnson Drive and Shawnee Mission Parkway.
Basically, this was approved once before but the DeSoto USD 232 put a stop to it.
Now it has come up for reconsideation, and the city has reapproved it. It would appear that neither of the two school districts or any other taxing authority involved will object.
So, here is the $64, 000 question (remember that TV show?): What do the families that own this property intend to do with it?
At this stage, they do not have to say. Once plans are developed then their intentions will be known, as each project will need separate approval.
First and foremost, are they going to develop it themselves, or are they planning on selling it? A chunk of land that has been recently designated as TIF has got to be more valuable to a potential developer and could possibly show a nice profit for its current owners on resale. Heck, these three prominent Shawnee families didn't get that way by staying home and watching TV.
But, that is almost immaterial as they may choose to not sell the property but to develop it themselves. Either way, that again brings up the question: What will be done with it?
1. Will it be developed as housing subdivisions? Does Shawnee need more housing? Will Shawnee need more housing down the road?
2. Will it be some sort of mixed use like Zona Rosa on the Missouri side? Or what is being considered for the Metcalf corridor to replace Metcalf South?
3. Will it be office park? Warehousing? Light manufacturing?
4. Will it be destination shopping and entertainment (like Village West)?
5. Will it be mostly hospitality oriented (restaurant and hotels) to get some of the overflow from the events at Village West?
6. Will it be a combination of any or all of the above?
Time will tell.

Shawnee PD Adapting to Situation
Kudos to our Shawnee PD
There is apparently a relationship between vehicle crashes and other crimes. Our PD has analyzed this and is taking a proactive stance to work towards reducing both.

Salute the Flag, Not Your Drink
I have sent the item below to the Shawnee Dispatch as a letter. Hopefully they'll publish it and more people will be aware of this:
This past Saturday was the annual Old Shawnee Days parade. As usual, a nice turn out and some really great participation by folks marching in the parade.
But something is bothering me. At the beginning of the parade, when the American Legion Color Guard stepped off, the lack of respect by those watching was abhorrent. Mike Thompson, announcing the event, asked all to rise. Standing across from the grandstand I did notice just about everybody stand. What I also noticed was that most were continuing their conversations and drinking their drinks. Less than a dozen folks in my field of vision actually paid proper respect by saluting the flag. Is it so difficult to shut up, stop drinking, and place your hand over your heart for approximately 60 seconds? Must be. And, while you are at it, teach and show your children respect for the flag?
Don't know what the reaction was along the rest of the parade route. Would venture a guess it was the same.

Those Who Serve, To Protect and Defend
Today is Memorial Day, and all across the country many words were being spoken to honor those who gave their all in defense of our country.
Last week, the City of Shawnee and many of her friends and neighbors turned out to render honors for Firefighter John Glaser.
These two events make me wonder about one thing? Why can't we honor these folks while they are still alive? True, there are certain periods of the year that are designated for this.......but why not on a daily as it happens basis?
Ever go grocery shopping and see a couple of firefighters there also? Buying food to cook on their watch. Would it be so terrible just to say thank you as you walk past them? Or give them a thumbs up? Or an "ok" sign? How many of those meals have been left on the table to spoil because just as they sat down the bells rang?
What about that police officer that you just saw walking back to his/her car? A thank you for his/her efforts to protect us would be nice. Ever get a speeding ticket? Or stopped for running a redlight or a stop sign? Maybe you need to thank that officer then too. He/she may just have saved your life, or even stopped you from injuring or killing someone else.
And last but not least our military members. Sure, we have Memorial Day, Veteran's Day and Armed Forces Day (honoring those who have passed on, those who have served and those who are serving). But what about what happens when you pass one of these folks in the store, on the street, at the airport etc?
A simple thank you, a thumbs up or an "ok" sign would probably mean alot.
These individuals do not "sign up" for these jobs for the glory. They do it because of a desire to serve their fellow man..............to protect us, to defend us.
Say something to them to show your appreciation, and admiration, while they can still hear it. It will mean alot to them.

Condolences to the Glaser Family
Our condolences go out to the family of Firefighter John Glaser who died in the line of duty over the weekend.
Sometimes we forget the dangers that public safety personnel face while performing their duties. Then an incident like this becomes an unfortunate reminder.

Survey Results - Ten Quivira Plaza
Not exactly scientific, but just as valid (maybe even more so) as the 3 person interviews that the Dispatch does.

New State Texting Ban
OK, the legislature has banned texting, in the state, while driving.
Now it's up to the governor to sign the bill into law.
This is a step in the right direction. Personally, I am a little upset that the bill did not contain restrictions on talking on a cell phone also. An Additional Look at that CID
In an article today in the Shawnee Dispatch on line

Council member Jeff Vaught showed some support for the district, saying most shoppers weren’t aware of sales tax rates in the various locations where they shopped. He noted The Legends in Kansas City, Kan., was one of the most successful shopping centers in the area but had one of the highest sales tax rates.
Well, let's look at it this way: The Legends ( Village West) may have one of the highest tax rates. But, that is exactly the type of location that the CID needs to be used for. A destination location, that will rely mostly on transient spending as opposed to a local neighborhood shopping center.........especially one with the major tenant being a grocery store. (See my blog post below with the reference to the Journal of the Kansas Bar Association)

And their ward (Ward 3) probably has the highest per capita income in the city, and the least number of retired and fixed income folks.

Council Vacancy & the Quivira Plaza CID
1. Well, at the special council meeting Jim Neighbor was appointed as the Ward 1 council person to fill the unexpired term of Cheryl Scott. My opinion on this is pretty well known via my previous posts. Certain members of the council, used, IMHO, some convoluted logic for giving it to him. A good guy, but, again IMHO not the best qualified. The mayor denied that there was any predetermination as to who would get the position. He must be right, and that means I am just super clairvoyant since I've been saying that no matter what, Neighbor would get it.
2. The public hearing for the CID (with its accompanying 1% sales tax) had various members of the community speaking out against it. No action was taken last night as this was a public hearing only. Council could have killed it completely but they didn't. It's possible that city staff could work it out differently and bring it back.
Five members of the council were pretty specific in saying that they would not vote for it with the 1% sales tax. These were Michelle Distler, Dan Pflumm, Neal Sawyer, David Morris and Mickey Sandifer. If Sandifer doesn't pull a flip-flop that would be enough to stop it. Dawn Kuhn and Jeff Vaught seemed to be leaning towards wanting this. The newly appointed council rep, Jim Neighbor didn't voice any opinion.
Interesting to note that the store director for Price Chopper said that they had no opinion at this time since they had not been consulted and had not had time to review the item.
An article in the February issue of the Journal of the Kansas Bar indicates that these types of financing plans should be for areas that would attract mostly transient shoppers as opposed to local neighborhood centers. The three current CIDs in Kansas are along I-70. One includes a truck stop (Maple Hill) and the other includes a motel (Hays). Common sense says those would have a tendency to derive most of their sales (and the corresponding sales taxes) from transient customers. I am currently trying to determine what is in the third one, though it too is along I-70, in Junction City.
Sidebar:
A resident, while voicing her opinion against the project was also critical of Dawn Kuhn's lengthy comments. After the resident took her seat, Kuhn then went on to explain how her constituents elected her to express those opinions and yada yada yada (ad infinitum). From her seat in the audience the lady said "be concise". Don't think the lady was saying that Kuhn shouldn't voice her opinions, it's just that Kuhn has a habit that if something can be said in 60 seconds she stretches it out to 5 minutes, 10 minutes etc etc. Is Dawn Kuhn a graduate of the old fashioned used car salesman school? You know, the one that goes, "If you can't dazzle them with brilliance then baffle them with BS".

Sandifer's Travels
Remember a few months ago when former Councilmember Straub asked Councilmember Mickey Sandifer what Sandifer's trip was about? And then Sandifer's reply of "none of your business". I mentioned that here, and in a published letter to the Shawnee Dispatch. Sandifer never emailed me with an answer.
Anyway, a request under the open records act was made to the city for copies of Sandifer's expense reports from Jan 1, 2009 to present (as of 4/19/10).
Here is the info. Just keep these numbers in mind when you hear him talk about how concerned he is about certain budget items. Then decide for yourself what his sincerity level is.

Reimbursed by NLC (634.75)
Net Expense to city 1,459.43
November 2009.....................................$2,397.63
March 2010............................................$3,184.55
Remember, on his most recent sojourn to Wash DC his expenses were the highest of any of the city's attendees and he was there the most number of days.

The applicants for the vacant Ward 1 council seat will be interviewed and probably selected. If you are in Ward 1 this is important to you. If you are not in Ward 1, the way this is handled is also important to you.

The public hearing for the proposed Community Improvement District for 10 Quivira Plaza (Shawnee Mission Pkwy & Quivira Rd) is on the agenda. This would involve, among other things, a 1% sales tax increase just for the stores in that shopping center (Price Chopper being the largest one). That increase would be used for the rehab of the shopping center.
Be there and exercise your rights to voice your opinions.

City Support For Statewide Texting Ban
After I gave my presentation on 4/20/10 (date edited on 5/16/10 because of typo it originally showed as 3/20/10) it was obvious that the city was still not going to consider a local ordinance regarding the use of cell phones. When I said that it would be good if the city would at least officially support state action I was informed that that had been done.
That came as a surprise since I did not remember any press release or other public notification of that action.
It turns out that back in January Mayor Meyers sent letters to each of the five state representatives that have portions of Shawnee in their district (Talia, Brown, Donohoe, Neighbor & Quigley) supporting state action on this topic. The city forwarded to me copies of the letters. The letter to Mr Talia is reproduced below, as the others are the same.

O'Connell & Nachbar Top My List
Well, I have looked at the resumés for the five applicants for the Ward 1 seat First, let me say I would still like to see an election. That probably is not going to happen. So, what about the five who applied? All of the resumés look good, but to me, two of them stand out.
Those two are James J O'Connell and Gregory P Nachbar.

- Major positions with various professional organizations
- My comments: Individual has a history of being in positions that require decision making, fiscal responsibility and team building. My first choice.
2. Gregory P Nachbar.......a brief synopsis
- Most recently, over 20 years with a major ($300m) corporation. His resumé would indicate a strong background in a senior management position responsible for various functions to include purchasing, HS&E, and meeting financial and operational targets
- My comments: Strong corporate experience with responsibilities in many areas that require the ability to be a decision maker. One does not stay and advance with the company he works for by making wrong decisions.

Reminder - Community Improvement District
Just a remidner that the public hearing for the proposed Community Improvement District at 10 Quivira Plaza (SMP & Quivira Rd) is scheduled for the regular council meeting on Monday May 10, 2010. The regular meeting will follow the special meeting regarding the selection of a replacement to fill the Ward 1 council seat.
Remember, part of the CID is the establishment of a 1% additional sales tax for the shops in that center, to help fund the improvements.
It is amazing how two newspapers handled the reporting of the postponement of the public hearing from March 26th to May 10th.

Info Will Be Posted Earlier
Great news regarding the posting of the Ward 1 council applicants info.
I received an email from the mayor which indicates that the information will be posted on the city's website either tomorrow or Monday. It can only be guessed that folks did use the link to express their opinion to the mayor.
This will now give the citizens of Shawnee (especially the residents of Ward 1) the opportunity to review the applicants' backgrounds and qualifications. Now all they would have to do is to attend the council meeting May 10, and if they have any questions and/or concerns, to voice them.

In this case, it is just my opinion that the applicant info needs to be made available earlier so folks can have some real time to review it.

Sock It To Me
Who remembers the old Rowan & Martin show "Laugh In"? Remember the old 'sock it to me' antics? They were funny.
We have a current 'sock it to me' though that is not funny. That is the franchise fee that was enacted last August. Some of the council members spoke out against it because, among other things, they attempted to point out that as the utilities got rate increases, the dollar amount of the franchise fee would also increase.
Well, apparently KCP&L has applied for yet another price increase. The Kansas Corporate Commission is holding a public hearing on the proposed increase on Wed, Apr 28, 2010 at 7PM. It will be at the Matt Ross Community Center, Crown Room, 8101 Marty, OP, KS 66214.
People in Shawnee will get hit with the double whammy......or a double 'sock it to me'.......higher utility rates and higher franchise fees. One would think that because of that it would be newsworthy. Still, I don't remember reading about it in the local media (Shawnee Dispatch).
Just an FYI............. of the current sitting council only Pflumm and Distler were against the franchise fee. Kuhn, Sandifer & Sawyer voted for it, with Mayor Meyers breaking the tie. Of the former council members who were on the council when it came to a vote, Goode & Straub voted against it and Scott voted for it.

May 10, 2010 - Mark Your Calendars
That is the day that two hot items will be on the council's agenda.
Keep in mind that the session that night is scheduled to start 6:00PM.
1. First up will be the council reviewing applicants and most likely choosing a replacement for Cheryl Scott's vacated Ward 1 seat. I still think that the way the resignation was handled was an insult to the voters in Ward 1 as it avoided putting the seat on the general election ballot. The odds of the council allowing it to go to a special election are pretty slim. Even though that is what should be done.
I'm still willing to bet one of those $1 burger specials that the council chooses Jim Neighbor......the man that lost to Dan Pflumm in the last election. Maybe they'll use some convoluted rationale such as the fact that he got "x" number of votes, even though he lost. I still think that the way the resignation was handled was an insult to the voters in Ward 1 as it avoided putting the seat on the general election ballot. I'm still willing to bet one of those $1 burger specials that the council chooses Jim Neighbor......the man that lost to Dan Pflumm in the last election. Public Hearing to be Postponed - Sales Tax

Public Hearing - Sales Tax Increase
Don't forget that there is a public hearing on Monday @ 7:30PM as part of the city council meeting.
The purpose of the public hearing will be to review an application for a community improvement district at 10 Quivira Plaza (Shawnee Mission P'kwy and Quivira Rd). This is the shopping center that contains, among others, the Price Chopper store. If approved, the CID will include a 1% sales tax increase just on the stores in that shopping center.
Since this involves a sales tax increase it is important that folks attend and voice their objections or concurrences with the proposed sales tax increase.
Funny little side note: I did not notice any info in this past Wednesday's Shawnee Dispatch about this........as a reminder to the public. I guess that the possibility of a sales tax increase is not a newsworthy item. It's almost like somebody wanted to keep this under the radar so to speak.

Was I Asleep?
OK, it finally hit me this morning. Jeff Vaught came up with a bunch of nonsense last night (see my blog post below).
According to him, the Cato Institute said that vehicle accidents have declined but cell phone ownership has increased. Now, that I think back on that, so what? What is the correlation? Is Vaught trying to say that because more folks own cell phones that that reduces accidents?
Accidents can be down for a variety of reasons, some of which I mentioned in the post below. So cell phone ownership has increased. Is it possible that a good portion of the increase doesn't even drive? The Pew Research folks recently came out with a study that said 3 out of 4 children ages 12-17 now have cell phones. That's 75% of kids in that group, up from 45% two years ago. How many younger than 12 now have phones so mommy and daddy can stay in touch with them? What about grammy and grampy? How many senior citizens now have cell phones? Great way to keep track of the kids, grand kids and even great grand kids. Especially if they are out of state, what with all the various unlimited and family plans going around.
If this is the type of bovine scatology that is going to come out of Ward 3, wow, it's gonna be a fun 3 years.
By the way, are you going to publicly say whether or not you favor a strong state statute about cell phones and texting?

Also, as part of the press release the following info was supplied "Research by the National Highway Traffic Safety Administration shows that in 2008 alone, nearly 6,000 people were killed and more than a half million people were injured in crashes involving a distracted driver nationwide. Almost 20 percent of all crashes that same year involved some type of distraction."

- Have the number of people driving been reduced over the past couple of years because of telecommuting?
- Have more people resorted to shared transportation and/or public transportation because of the economy?
- Are less people driving because more folks are unemployed? Are more people taking 'staycations" (staying within their home area) as opposed to traveling vacations?
- Are more people reducing their other leisure time driving?
- Are they combining their errands to reduce the amount of driving being done?
- Do safety improvements (like ABS brakes) help reduce accidents?
Anyway, I'd still be for stronger laws in Kansas regarding cell phone and texting use while driving.
Hey, here's a good one.........for Jeff Vaught..........are you in favor of stronger texting/cell phone laws in Kansas? Now that's a simple question that does not need charts, graphs etc. Actually, it just needs a simple yes or no.

I received an email from a resident of Ward 1 concerning the potential sales tax increase that would be part of the proposed Community Improvement District:

Potential Sales Tax Increase
You could wind up paying an additional 1% sales tax of you shop in any of the stores at 10 Quivira Plaza. That's the shopping center at Quivira and Shawnee Mission Parkway, the one that has Price Chopper in it.
There will be a public hearing at the city council on Monday, 4/26/10, at 7:30PM concerning this matter.
Here is what it is all about. The ownership of the shopping center has petitioned the city to create a community improvement district. See the info at

Basically there are two things that happen:
1. The owners pay an additional assessment with their property taxes. This additional assessment is used to defray some of the costs of rehabbing the shopping center. Hey, it's the owner's money. Do it.
2. The stores in the shopping center charge the public an extra 1% sales tax. This money also goes to the ownership to help defray some of the costs of the rehab. Whoa..........
The city has recently hit the residents with a 5% utility (gas & electric) franchise fee. Ouch. Have the utilities started petitioning for rate increases? Another ouch. The major retailer in this shopping center is a grocery store. Hey, we don't need groceries to live. More ouch. The shopping center is frequented by many folks of what may be referred to as modest income. Keep on ouching.
Whatever happened to the concept of businesses using their funds or loans to build their businesses? If the sales tax is approved, and if the shopping center is improved, and if the ownership sells it down the road, would they cut the citizens of Shawnee in for a percentage of the sale profits?
It is very important for folks to attend this public hearing and voice their opinion. Even if you don't shop in that area, this is an item that could happen anywhere in the city.
So, if you are for or against a community improvement district, show up and be heard. Remember, public hearing, Monday April 26, 2010, city council chambers at 7:30PM.
Curious, as to how much "play" the local media (Dispatch) has given to this, other than publishing the requisite public notice?

Did I Blow It?
Wow, I really blew it when I posted my comments about the meeting of 3/22/10 and how the Dispatch didn't question certain items

How did I blow it? I missed the most important thing..........the fact that Scott delivered her resignation to the city manager instead of to the mayor.
OK, here goes. The city manager is appointed by and works for the council. Ergo, it is the mayor, not the city manager who is a council person's "supervisor". As such Ms Scott's resignation should have been delivered to the mayor and the council and not to the city manager. The city manager's comment that she didn't notify the mayor prior to the council meeting because she hadn't reviewed it is ridiculous. It was not her position to review it. It was her responsibility to notifiy the mayor immediately upon receiving it. By withholding this information from the mayor would this be insubordination? And then by staying quiet when Straub asked his question about Scott's regnation was definitely wrong.
So, that is how I blew it. By not pointing out who should have received the resignation to begin with. Has the mayor reprimanded the city manger for not delivering the info to him in a timely manner? Or, for remaining quiet when Straub asked his question? Or do we have a defacto reversal of positions in Shawnee city government?

Do you think the council would vote to give the open seat to Jim Neighbor, who lost to Dan Pflumm in the election?

The Resignation Saga Continues
At tonight's council meeting, with the 60 day countdown beginning tomorrow, I just had to write and then read an open letter to the council.
Following is the letter:

To The Mayor and City Council, City of Shawnee, Kansas
The city has recently posted information soliciting applications from individuals desiring to replace Council Member Scott as a result of her resignation.
I am going to suggest that the council refrain from appointing a replacement and let it go to a special election.
The manner in which this resignation was handled is abhorrent. Action could have been taken by the council member to resign in such a manner, with a delayed date, so that the seat could have been voted on during the last general election.
Now some folks are going to say that with the current financial situation it would be to the city’s advantage not to have a special election. So, let us address that with a simple time line and some common sense and logic.
In November 2009 Ms Scott purchased a new home in Arizona. The documents for that purchase were notarized by our own city clerk. Here is where the common sense comes in. It had to be obvious to other city officials, and members of the council that there would eventually be a resignation. As the mayor said on numerous occasions, he could do nothing until he received a resignation. But, again, it was obvious that eventually one would be forthcoming.
Knowing that, it was incumbent upon the city manager to plan for that day. Current Charter Ordinance 40 provides for a selection of a replacement by the remaining council members. If they are unable to do so, within a specified time (60 days) then it would go to a special election.
If one was to wager on this, then it would probably be 99% that the council would be able to perform that selection. Still, since city councils can become fractious, and this one is no exception, there would always be the possibility that they could be unable to select a replacement and a special election would be necessary. Therefore, back in November it would have been proper planning to plan for the availability of funds in case that became the scenario. Did the city manager, or does she now have a plan to pay for a special election? Gosh, did we give Wonderscope that $10,000 that many thought was unnecessary? Why did we plan for 5 people to go to DC for the NLC conference? Why not only 2? If Sandifer and Kuhn had stayed home we could have saved almost $6,000. Are there other areas that could have provided the necessary funds? Like reducing or eliminating any future travel this year by council members? Or do certain council members need to take additional trips?
It would be incumbent upon this council to validate the will of the people by allowing the voters of Ward I to elect Ms. Scott’s replacement.
I would hope that Ms Scott, who has given up many hours of her time to support veteran’s causes, would agree with the statement that many have served and many have paid the ultimate sacrifice to preserve the right of the people to elect their officials.

DC Dollars
Well, a contingent of Shawnee officials went to Wash DC recently for the National League of Cities Conference. Attendance at these types of conferences can be beneficial to the city. My only question is why did we need to have four people go? Actually, it was planned for five originally but Neal Sawyer had to cancel because of business commitments.

What gets me is Mickey Sandifer, the man who spent quite a bit of money traveling to Texas for a meeting and now is the council member that spent the most in DC and was there the most number of days. The same man that was concerned about the potential loss of city emergency services because of budgetary problems. C'mon Mickey, get real.
My next question is why plan for 5 people? Couldn't we have done just as well with 2? The mayor and the city manager?
I was wondering, back in February when the trip was mentioned at a council meeting how it was determined as to who went, especially with regards to council members. I erroneoulsy had been lead to believe that they were "selected", so I sent an email to the city manager and she explained the process. This is from her reply to me on 2/23/10:
Ray,Each year staff reminds Governing Body members when the time to registerfor Spring NLC comes and asks whoever is interested to respond. We have always left it up to individual council members to make their own decision on whether to attend or not.

Election Results 2010
Well, I think I'll start with Ward 4 since that is where I live. Michelle Distler, a true independent thinker, literally blew away her challenger Loretta Barngrover 521 to 281 (64.96% to 35.04%).
In Ward 3 it was Jeff Vaught 467 over Dennis Kissinger 404 (52.89% to 45.75%).
Ward 2 has challenger David Morris at 474 victorious over Shawnee's local elder statesman Frank Goode at 323 (59.25% to 40.38%).
And, in Ward 1 Dan Pflumm will return to the council defeating Jim Neighbor 735 to 645 (53.11% to 46.60%).
The new council will choose the council president at their first meeting. Personally, I think after holding that position for two years that it is time for Dawn Kuhn to not be given a third year. Naturally, considering the confidence that her constituents have placed in her, I firmly believe that Michelle Distler would make an excellent council president.

Picture Truly is Worth 1000 Words
Two years ago when Mickey Sandifer was up for reelection he was whining and crying because he felt that some council reps were working with his opponent against him (Michelle Distler was not one of them)
Now, Mr Whiner and Cryer is doing that same thing to Michelle Distler. What a hypocrite he is.
Anyway, a fellow 4th Ward resident sent me the photo shown below of Lori Barngrover's sign in Sandifer's front yard. That individual told me that that helped make up their mind not to vote for Barngrover.

Definitely, Michelle Distler, the incumbent, is the better candidate over the challenger Lori Barngrover. Distler, is a true independent thinker.
Anyway, IMHO Barngrover has some baggage...............it's a suitcase called Mickey Sandifer.
Another Ward 4 resident told me they had seen Sandifer taking Barngrover around and introducing her. Yepper, the same Sandifer that says it's none of our business how money was spent on one of his trips. The same Sandifer who tried to instill fear in folks that if the last budget wasn't approved as recommended that essential emergency services could be lost. The same Sandifer that tried to convince some folks that unless the franchise fee was passed that the city might be liable to lawsuits.............and the same Sandifer who on the last trip to DC spent more money than any other person who went and stayed more days than anybody else.
Would Barngrover become a Sandifer clone?

Scott's Resignation - It Gets Deeper
Well, the Shawnee Dispatch has another updated article on the Scott resignation. It can be seen here: http://www.shawneedispatch.com/news/2010/mar/31/scott-leave-council-april-13/
There are so many holes in that article. I wonder, does the Dispatch (aka Cheerleader) just take what they are told by the city as gospel or do they ever question things? In a previous posting I mentioned Judge Judy's book, "Don't Pee On My Leg And Tell Me It's Raining". Well, she has another comment that she uses: "If it doesn't make sense, it's probably not true."
OK, here are items from the article. Rather than comment at the end, I'll toss my comments in between them. The Dispatch comments will be in blue, my thoughts will be in red
Shawnee City Council member Cheryl Scott is resigning her Ward I seat effective April 13, but the much-anticipated resignation and the timing of its announcement are causing ripples of criticism.
Scott, who has sold her Shawnee home and is moving to Arizona, submitted her letter of resignation Friday, March 19, at City Hall. During the regular Council meeting on Monday, March 22, Council member Kevin Straub asked if Scott had yet submitted a resignation and whether there had been any discussions about selecting her replacement.
At the time, Mayor Jeff Meyers reiterated his stance that he wouldn’t have knowledge of Scott’s resignation until he received a letter from her.
So, from Friday until Monday nobody told the mayor about Scott's resignation? In the council meeting room, before the council meeting, Scott never said anything to the mayor? Did they have a one on one discussion before the meeting? C'mon now. I need a towel.........I feel something wet on my leg.
Gonzales, who later said she had reviewed Scott’s resignation letter earlier that day but had not told the mayor about the letter, did not comment on Straub’s question, nor did Scott. By not answering Straub at the meeting are they guilty of lying by omission?
When Scott’s resignation was announced publicly three days after the Council meeting, Straub began raising questions anew.
He said he believes Scott and Gonzales’ silence serves as evidence the resignation was delayed because some Council members want to replace Scott with an appointment of their choice. As it now stands, Scott’s replacement won’t be selected until after the April 6 elections in which three incumbents are facing challenges. Straub’s seat also is up for election Tuesday, but he was defeated in the March 2 primary.
"Why wasn’t it announced, why did we hold off?" Straub asked of the letter of resignation. "When the mayor came out and said ‘I have no knowledge of it,’ why didn’t the city manager correct him? Why did Cheryl think that the new City Council, the ones who are elected in April, would be better to pick her replacement than the voters?" Good questions!!!
Meyers said it was up to Scott to decide when she would resign.
"Cheryl is the Council member who has to make that decision, and who’s to say that she wasn’t going to change her mind at some point?" Meyers said. Right, she might change her mind. Bought her new house in November, near her daughter. Sold her Shawnee house in December. Just might change her mind? Where's that towel?
On Thursday, Scott confirmed she was resigning in order to move to Arizona. Wow, now that's a surprise......not.
"I was elected to do what I felt was right, and to me, this was the right thing to do," she said.
Scott declined further comment. Right, it's the right thing to do to let the council select your replacement, rather than the voters.........not.
Gonzales said she didn’t want to correct the mayor during the meeting and continue a discussion among Council members about Scott’s replacement before she had had a chance to discuss the issue with Meyers. Again, is this lying by omission? As a member of the council, Straub was entitled to an honest answer from Gonzales who works for the council. Is she the one to decide if a discussion should continue? Believe that is beyond her scope of responsibility. And she says she didn't discuss it with the mayor beforehand? Huh??? And if not, why not?? As contentious as this item has become one would think that as soon as Gonzales got the letter she would have notified the mayor? She sat on it instead? Please, get me that towel!!!!!
Scott was first elected to the Council in 2004 and was re-elected in 2008. She has been involved within the community with the Sister City Committee, Old Shawnee Days, the Shawnee Great Grillers Barbeque Contest, and the Irish-American and German-American Clubs. OK
Controversy over Scott’s possible resignation arose in late January. Ward I resident Carri Donohoe Person and her attorney came to a Council meeting the day before the deadline to file as a candidate for the April Council elections and asked Scott to resign her seat.
Person said she had learned Scott planned to move to Arizona and that she had sold her Shawnee home in late December. Person said Scott should resign, allowing the Council to vote to put the seat on the ballot for April’s Council elections so voters could choose Scott’s replacement.
At the time, Scott said she would not resign until she changed her address. Marvin Rainey, city attorney, said city ordinances would not allow the Council to put the seat on the April ballot, even if Scott had resigned prior to the filing deadline. But what if she had resigned in November with a delayed date? The city could have notiffed JoCo elections that by the time of the April election the seat would be open. Considering that the Shawnee City Clerk notarized some of the purchase documents for her new home, common sense tells you it would be obvious that a move was in the works. Get me that towel....please.
In addition to giving up her Council seat, Scott indicated she was resigning from her positions on the Johnson County Solid Waste Management Committee and the Shawnee Convention and Visitors Bureau. Her last Council meeting will be April 12, which will be the same meeting Council members elected in the April 6 elections will be sworn in. OK
The resignation puts into effect the process of appointing a replacement Council member to fill out Scott’s current term, which expires in April 2012. The Council has 60 days to fill the vacancy before the city would be required to hold a special election. They don't have to appoint a replacement, they can let it go to the voters.
The replacement must be nominated by a Council member and approved by the majority of the remaining Council members.
Gonzales said the 60 days would begin the day Scott’s resignation is effective. Gonzales said the city would ask Ward I residents to send letters of interest to become Scott’s replacement, and those who applied would be interviewed at a Council meeting before a replacement is appointed.
"I would anticipate that will happen in early May," she said.

Scott Insults Voters of Ward 1
Cheryl Scott apparently doesn't think very much of the voters in Ward 1.

She could have resigned back then, with a delayed effective date, so that her seat could have been put on the April 6th ballot. She has since resigned, and with a delayed date, but too late to go on the ballot for the April 6th election.
Now, here is what what was published in the KC Star:

In an article on line dated Thursday, 3/25/10 (a day after the hard copy was published) the Shawnee Dispatch says "Scott submitted the letter Monday, though it is dated March 19". Did this item make their hard copy edition on Wednesday?
Now this brings up some interesting questions:
1. Why wasn't a public announcement made at the council meeting Monday 3/22/10?
2. Why is there still no mention of it as of this time on the city's website?
3. Was the letter dated the 19th and not submitted until Monday (22nd) because maybe, Scott didn't write it? Did someone in Shawnee write it for her? Was she in Arizona when it was written, and needed to return to Shawnee to sign it before the meeting on the 22nd?

Scott is Going Bye-Bye! Gee, What a Non-Surprise!
Well, Cheryl Scott has submitted her long overdue resignation, effective 4/13/2010.

Now watch the games begin. I smelled a set up in my original post and that odor is still there.
Ms Scott devoted many years to serving the community. It's a shame that she allowed herself to be caught up in this end around maneuver which could result in the voters of Ward 1 not being able to select her replacement.
The council will have two options:
1. Select a replacement within 60 days of the resignation.
2. Allow it to go to a special election.
Because of the obvious machinations that occurred here, this needs to go to the citizens to allow them to choose. Heck, she bought her new house in Arizona in November..........and the Shawnee City Clerk even notarized the documents for her. It was obvious what was happening.
In 1996 Judge Judith Sheindlin wrote a book published by Harper & Collins entitled "Don't Pee On My Leg And Tell Me It's Raining". We've been getting peed on since November.

Citizen Asks for Reports from NLC
At this past Monday's council meeting a resident, Rod Houck got up and made a suggestion.
He suggested that the five folks going to the NLC conference in Washington DC write a few paragraphs about what they accomplished. He indicated that those reports should be published on the city's website and in the Shawnee Dispatch.
I heard the mayor and Council Member Sawyer say that they'd have no problem with that. Didn't hear the other three say anything (City Manager Gonzales, Council Members Kuhn and Sandifer)
It appeared that Kuhn and Sandifer tossed some negative looks at Mr Houck. Guess they weren't too happy with that suggestion. Last Week's F & A Committee Meeting
Yesterday I received an email from the assistant city manager rescheduling my presentation.
I was supposed to give a presentation last Tuesday to the council's F & A Committee.
A couple of hours prior to the meeting's scheduled start time I received an email that the meeting had been cancelled. That happens from time to time.
Did a little digging though to find out what happened. Michelle Distler, the chairperson of the committee had a conflict. A very important conflict. Apparently the Kansas Department of Health and Environment was having a public meeting concerning the environmental clean up of the old Ken Smith Golf Club and factory which apparently has contaminated ground on the property. To her credit, Ms Distler has been involved in this since prior to her ever becoming a member of the Shawnee City Council. On top of that the KDHE originally scheduled the meeting to be held in Topeka which would have been very inconvenient for the Shawnee citizens living in the area, and wishing to attend the meeting. So she got the KDHE to move the meeting to Shawnee.
OK, now that leaves three members of the committee available (two make a quorum). Whoops, another one is out of the picture.......Cheryl Scott. Did she cancel out even before Ms Distler?
Apparently so. What was the reason for her not being able to make it? When I asked Distler if she knew why Scott wasn't going to be there , she didn’t know. Was she in her new home in Arizona? Commuting only for council meetings and not committee meetings? Would be interesting to find out.
OK, now that leaves two of the committee members. Aparently after hearing that Distler & Scott were not going to be there, Goode who was already at city hall cancelled out. So that unfortunately caused a late cancellation of the meeting and for my presentation to be postponed until the April 20th, Public Works and Safety Committee. Come to that meeting if you’re interested in hearing it.

Another Case of Voter Apathy
I have sent the following as a letter to the editor of the Shawnee Dispatch. If it gets published then hopefully more folks than those who read this blog will read it:
The voters of Ward 3 in Shawnee should be ashamed of themselves regrding the recent primary election.
Not because of the outcome, but because of their total, apathetic attitude.
The ward has approximately 11,000 voters registered and only 839 bothered to vote. That is less than 8% voter turn out.
Oh, they turn out for the presidential election......big darn deal. The president doesn't fix your pot holes, plow your streets, provide you with police and fire protection. The president doesn't set local property taxes, zoning laws and a host of other items that affect us daily.
The really sad part is that it is so much easier to vote in elections now than years ago. There is early physcial voting. There are mail in ballots (and you don't have to be disabled to obtain one).
Voting in an election allows a person to voice their opinion on what they want done in their community. Sitting on their collective rear ends and not voting is a relinquishment of that privilege and shows a willingness to accept whatever is thrown their way.
Too many of America's finest have continuously given of themselves to maintain the privilege of voting.To sit on your butts and not do so is an insult to them.

The Other Election
This past Tuesday voters in 3 Johnson County cities went to the polls. One ward each in Shawnee & Prairie Village had primaries.
The interesting election was down in Gardner. Two sitting council members faced recall elections. Recall elections are not common in JoCo. In this case the people spoke and the two council members have been recalled.

City council members in all cities need to realize that they are serving subject to the will of the people.

Upcoming National League of Cities
In a couple of weeks some members of the city council will go to Washington DC for the annual National League of Cities conference. There can be some good that come out of these things.
Let's take a trip back in time to last year. Because of the city's financial situation,, only four people were scheduled to go. Two council members, the city manager and the mayor. In reality only three went because of a problem with the flight for one of the council members.
This year we have five people scheduled to go. The city manager, the mayor, and three council members: Sawyer, Sandifer and Kuhn.
Now if I understood what was said at the last council meeting only the mayor and councilmember Sawyer are leaving here on Sunday. That's good. The other three are apparently leaving on Friday.
Well, with the city's finances being what they are why are 5 people going?
Here are my suggestions:
1. Reduce the number of people going to four. With all the travel that Sandifer has done in the past twelve months he can stay home. Especially since he apparently thinks it's "none of your business" to explain the costs of his trip to Texas.
2. Have the remaining four leave on Sunday.
3. Let council member Sawyer and the mayor double up on a room and the city manager and council member Kuhn can do the same thing.
The city would then save a bunch on hotel nights and per diem costs(by both reducing the number of nights and using double rooms) and, by leaving here on Sunday, that would cut down on both even more.

Thieves in the Night
It has been reported that there are sign thieves out there. Yep, folks that go around stealing the political signs of candidates.
How sophomoric. How illegal. When a homeowner gives a candidate permission to place a sign in their yard they are exercising their right to free speech.
When a thief steals that sign they are trespassing on the property, and they are stealing something of value. Curious, since it involves free speech before an election I wonder if maybe, just maybe there could be a federal civil rights violation here?
I don't care who the candidate is, stealing of their signs is just wrong.........and illegal.

Political Cowards
Freedom of speech is great. One example is this blog, and the thousands of others out there, letters to the editors of newspapers etc.
What irks me though is when people say things (read that as attack) but they do not have the courage or intestinal fortitude to identify themselves. Those folks are nothing more than fecal matter.
What is setting me off? A mailer recently was mailed with some negative info about Kevin Straub. Hey, they even referenced an old blog post of mine. What gets me is the signature block: "FOR INFORMATIONAL PURPOSES ONLY, NOT PAID FOR BY ANY CANDIDATE"
Well, how do we know it wasn't paid for by any candidate? Since whoever was responsible for this failed to identify themselves. Anybody can prepare that statement, even another candidate since there is no information showing who, where or when this item was prepared.
That is cowardly. Additionally, if they are attacking one candidate, then deep down they must have positive feelings for another one.
Methinks I know who is actually responsible for this. Just a hunch, but without proof I can't say.

Ward III Primary......Tue, March 2, 2010
There will be a primary in Ward III next Tuesday, 3/2/10. Four individuals are running and the top two vote getters go on to the general election on April 6.
In the past I've had some issues with Kevin Straub...........no denying that. But in this election I'd have to say if I lived in Ward III I'd vote for him.
Sound bytes and blurbs on campaign literature aside...........I've been to many council and committee meetings this past year. Straub's actions to try and maintain freedom of choice with regards to trash disposal are to be commended. Contrary to the comments of his wardmate. The same goes for his feelings towards the franchise fee.
His methods are sometimes unorthodox, but he is something of a rebel. Sometimes being a rebel is good.
Now, when it comes to challengers' comments about "restoring civility" to the council. Heck, they're going against the wrong person. Wanna restore civility to the council? Unseat Diva Dawn Kuhn in 2012. I've sat in on these meetings. I've heard her antagonize and bait Straub on more than one occasion, and on others get downright nasty. When Straub was having problems getting some info from the city manager, Kuhn was heard to chime in with "Well, I always get answers to my questions" Right.........the queen of the rubber stamps gets what she wants.
Civility? What about Mr Travel himself, Mickey Sandifer. When asked to explain some travel costs, in a council meeting, his reply was 'None of your business". (By the way Mickey, this constituent is still waiting for your explanation, and it is my business). This is another one that would need to go in 2012 to restore civility.
Nobody agrees with everybody all the time. Straub is very passionate in what he believes. I don't always agree with his methodology, but he does care.
Unfortunately it's too late for me to move to Ward III to vote for him.

Great Scott.......Part 2
Well, it looks like the Shawnee Dispatch has rendered an opinion on this situation (see my blog post below from January 30, 2010....."Great Scott!!!!!!.........Is She Moving?????)

As pointed out, Cheryl Scott could have resigned in time for the seat to be placed on the spring election ballot. The resignation could have also had an effective date to coincide with the election, so she would not have had to leave office prior to then.
When she does resign, the only way her replacement will chosen by the voters is if the council does not act within 60 days and then the matter would go to a special election. Highly unlikely because of costs.
The only question that remains is did Ms Scott choose to delay her resignation or was she encouraged by others to do so? And if she was encouraged to delay the resignation by others, who are they?

Another Modification to the Crystal Ball Post
Whoa......now I've received an email from Jessica Marshall basically standing by the use of the term "abatement";

The content of the email is as follows and should clarify the situation:

I do appreciate your attention to the project I am bringing to downtown, but I would ask that you reconsider what appears to me to be a negative tone toward the incentive. As you will see in the attached public documents, this property falls within a downtown revitalization district and is therefore subject to a rebate - not abatement - of taxes generated from improvements to the property. In other words there is no cost to the taxpayer as without the improvement the property value the corresponding taxes would remain unchanged.
Thank you for considering."

Sun Publications Has a Crystal Ball
A recent article in the Jouhnson County Sun was about Stag Commercial Properties acquiring the Commerce Bank Building. The article goes on to explain what the owner of Stag has in mind.

One thing about the article that has me confused is this statement:
"Tubbesing will (emphasis added) receive a tax abatement as part of the city’s Downtown Improvement Incentive Program, which is available for new construction or building improvement that increases the value of a property in the Neighborhood Revitalization Area. Loans and grants also are available for downtown business owners."
Since tax abatements have to be voted on before anybody will receive them I guess the writer of the article must have a crystal ball. Maybe the writer can pick out the next winning lottery number for me? Redevelopment/revitalization is good.................but how does one know ahead of time how the council will vote?

One thing about the article that has me confused is this statement:
"Tubbesing will (emphasis added) receive a tax abatement as part of the city’s Downtown Improvement Incentive Program, which is available for new construction or building improvement that increases the value of a property in the Neighborhood Revitalization Area. Loans and grants also are available for downtown business owners."
Since tax abatements have to be voted on before anybody will receive them I guess the writer of the article must have a crystal ball. Maybe the writer can pick out the next winning lottery number for me? Redevelopment/revitalization is good.................but how does one know ahead of time how the council will vote?
