State Rep John Rubin's Bills for More Transparency in State Government

Our Shawnee Representative in the Kansas House, John Rubin, has long been an ardent advocate of full governmental transparency and accountability.  He believes that responsible governance demands that elected officials always strive to fully inform themselves on the issues and all aspects of legislation on which they vote, to cast informed votes, and always to disclose to their constituents how they voted on the public policies that affect the lives of Kansans.

For these reasons, Rep. Rubin is now fighting to change longstanding Kansas legislative practices of bundling multiple bills in a single conference committee report for one vote under the Joint Rules, and of not recording votes on bills, resolutions and amendments in the Committee of the Whole on General Orders under the House Rules, practices he believes are undemocratic.   He has drafted resolutions amending the Kansas Legislature's Joint Rules and House Rules to correct these undemocratic legislative practices, and plans to prefile them the week before the 2014 legislative session starts.

The first is a Concurrent Resolution amending the Joint Rules to provide that a conference committee report may contain only the bill being conferenced and all or part of one other bill that has passed either Chamber during the current term.  Existing practice allows for an unlimited number of additional bills or parts of bills  to be added to a conference committee report (CCR).   Often, legislators have little if any opportunity to fully inform himself or herself of the contents, consequences or effects of the many additional bills in a CCR, particularly if the added bills did not originate in and were not debated in their Chamber, and particularly under the pressing time constraints experienced late in session, when most of these CCRs are considered.  Accordingly, the likelihood that most members are even marginally well informed on the votes they are asked to cast on these multi-bundled CCRs is slim.  Worse, it is highly likely than in any CCR with six, eight or more such bills, a member may fully support some of the bundled bills because they square with the member’s principles and are, in his or her view, good public policy, and may oppose others because they are not.  In short, current practice virtually ensures that members often cast uninformed and unprincipled votes on much of the public policy contained in multi-bundled CCRs.  Rep. Rubin believes that is no way to govern.  His Concurrent Resolution will correct these irresponsible and undemocratic  practices.

The second Rubin proposal is a House Resolution amending the House Rules to require that all House floor votes, whether in the Committee of the Whole on General Orders or on Final Action, shall be recorded votes.  Current practice on General Orders in the Kansas House is that all votes on bills, resolutions and amendments are voice votes, or, on a division call,  unrecorded electronic votes, absent a show of 15 hands requiring a recorded vote.  Make no mistake – those “unrecorded” electronic division votes are in fact being recorded outside the chamber and in the House Gallery, by handwritten notes, camera phones directed to the closed circuit television screen, and otherwise,  by government officials, lobbyists, and other political insiders vested in the outcomes of these votes.  Rep. Rubin believes that citizens should have the same access to these vote results that political insiders do.  Moreover, all Kansans are, in  his view, entitled to know how legislators vote on every public policy question put to them – in bills, amendments and resolutions – not just on Final Action, but preliminarily on General Orders as well.  In his view, legislators' oath of office and their responsibility to be transparent in their votes and accountable to the people of Kansas for them require no less.

I applaud Rep. Rubin for his noteworthy efforts to enhance public transparency and accountability in the Kansas Legislature.

New Kid on the Block

Well it's been almost two months since Stephanie Meyer was appointed to the city council for Ward III.

How has she been doing?  Well, it all depends on what items are of interest or importance to a person.

On three recent items I would have to say that Ms. Meyer definitely was "for the people", which I think is good.

1.  At the council committee meeting regarding changes in PS-7 and public input at committee meetings, she spoke in favor of citizen input and that is how it finalized.  Note:  Her ward mate, Jeff Vaught expressed a position that would have reduced public input.

2.  At the council committee meeting regarding the ballot for the proposed sales tax retentions and increases, Ms. Meyer spoke in favor of letting it go to the November general election.  That would be a no cost election for the city.  On the other hand, her ward mate Jeff Vaught spoke in favor of making it a mail in ballot in the spring which would cost the city $100,000.  Yepper, 100 big ones.

3.  At the city council meeting that saw the appointment of Alan Willoughby (the mayor's uncle by marriage) to the planning commission, Ms. Meyer voted against it, wanting to see more representation from the west side.  Her ward mate, Jeff Vaught voted for Uncle Alan, which kept the planning commission unbalanced as to equitable representation by areas of the city.

So, on these three issues how would I rate her?  Three actions "for the people".  Good job.

Her ward mate, Jeff "The Arrogant One" Vaught on these three actions was definitely "against the people".  Puke time.

Jim Neighbor Claims Planning Commission is Unstable

At the recent city council meeting that saw the appointment of Alan Willoughby (the mayor's uncle by marriage) Councilmember Jim Neighbor, Ward I said that we had a young planning commission and that Willoughby would bring stability.  Needless to say, Neighbor was one of four who supported the nepotistic appointment of Willoughby.

Young?  Chronologically young?  Time of service young?  Is Mr. Neighbor saying that the planning commission is unstable?  Apparently so, if the appointment of Uncle Alan would bring stability to it.

So, let's look at the time of service dates of the members, not counting Willoughby:

Bogina        12/2002
Bienhoff       2/2005
Busby           8/2007
Schnefke      9/2009
Hageman      7/2011
Kenig            2/2012
Fiser             6/2012
Navarro        8/2012
Wiseman      8/2012
Sheahan       8/2013

Willoughby's 1st term on the commission was from 4/2010 - 7/2012.  Actual previous time would give him just two more months service than Commissioner Hageman.

What's wrong with that make up?  What kind of stability can Willoughby bring?  Was Neighbor referring to their actual ages?  Don't know and don't have that info.

I do remember there was a time, not too long ago when Councilmember Vaught made some negative comments about some who at that time had service on the council over 20 years.

So, what is the proper balance?  And if the planning commission is/was unstable maybe the mayor needed to ask for resignations.

I think Neighbor's comments were a bunch of nonsense.  Actually I think they were something else.

Mayor Breaks Tie Vote to Get Uncle Alan Appointed to Planning Commission

If you followed my post from last week, (scroll down, it is the one from 12/5/13) you will see that Mayor Jeff Meyers was recommending his uncle by marriage, Alan Willoughby to the Planning Commission.

You may remember that it was Willoughby's appointment to the city council to fill an open seat that prompted a KOMA investigation by the JoCo DA.  The investigation resulted in a letter that was definitely a reprimand.

So, what happened last night?  When the mayor put Willoughby's name out there it started an interesting discussion.  It seems that with the recent appointment of Stephanie Meyer to the City Council (which created the opening on the planning commission), that the make up of the commission became even more lopsided.  Of the remaining 10 members, only 2 live west of I-435 and only one of those resides in Ward III.  Willoughby's application was dated last Wednesday 12/4 just in time to make it on the agenda.  Ironically, a Ward III resident put their application in within days of the aforementioned council appointment.

Yours truly got up and suggested that the council table the item and look to find an individual out of Ward III to fill the position.  This would be a step towards balancing the commission and also involve folks who live in the area of the city with the most future growth potential.

You would think that the Ward III councilmembers would be in favor of that.  Well, they were split.  The newest member of the council, and from Ward III, Stephanie Meyer did voice objections to Willoughby's appointment.  And she was right.  On the other hand, Jeff "His Royal Arrogance" Vaught raised all kinds of bovine scatological arguments to support Willoughby.  Guess he really doesn't care about the folks in his own ward.

What was the final result?  Four councilmembers voted against the Willoughby appointment.  Those four were Dan Pflumm, Ward I, Mike Kemmling Ward II, Stephanie Meyer Ward III and Michelle Distler Ward IV.  These four did the right thing.

Who were the four that supported the mayor's nepotistic action?  Jim Neighbor Ward I, Neal Sawyer Ward II, Jeff Vaught Ward III and Mickey Sandifer Ward IV.

So, now we had a tie.  The mayor chose to use his tie breaking powers to appoint his uncle by marriage to the planning commission.

Vaught Pushes to Waste $100,000 of City Funds

Wow, the headline is a strong statement.  But, it is a fact.

At last Tuesday's (12/3/13) Council Committee meeting an item came up to put the issue of continuing two sales taxes (collectively known as Parks & Pipes) and a new one for pavements, on a ballot for the citizens of Shawnee to vote on.  The merits of the taxes will not be discussed in this post.

Now that is the way it should be.  The citizens have a right to vote on these items.  Here's the problem:  City Manager Gonzales proposed a time line that would create a mail in ballot in the spring of 2014.  That would cost $100,000.  The city could put it on the ballot for the November general election at no cost.  The November election is a county wide election and cities can piggy back for zero dollars in election costs.  Various council members expressed concern about spending the $100,000 when the item could be put before the voters at no charge.

Councilmember Vaught appeared to be the primary proponent for doing it in the spring.  In his rants he even went so far as to accuse another council member of having "blinders on" because that council member had the temerity to disagree with His Royal Arrogance.  So much for civility, which Vaught has always claimed we need more of on the council, but is the first to be uncivil.  Vaught's concern stemmed from the concept that a tax question, on the bottom of a ballot during a partisan election would automatically be voted down.  Not so Mr. Know it All.  If the public is educated, regarding the pros and cons of the issues, then the citizens of Shawnee can make informed, intelligent decisions.  He even indicated that with a mail in ballot, the folks that had responded to the most recent citizen satisfaction survey (by mail) would be the ones to return them and then the items would be approved.
Looking around the metro there have been many tax items put on the ballot that have been approved, and yes, some have been turned down, but a larger turn out let's you know how the people feel.  This is something that if you listen closely to his comments, he is not in favor of............how the people feel.

Ironically, Council member Dan Pflumm challenged Vaught to the extent that Vaught was against spending $30,000 for a special election to fill the recent open Ward III seat, but now is willing to spend $100,000 instead of getting a freebie election.  Vaught's response was that there was a procedure for the council appointment set up.  He's right.  There is.  And it states that if the council does not fill the vacancy then it goes to a special election.  Naturally Vaught did not want that, even though 3 of the 4 interviewed for the position said it should.  Ironic, eh?

Anyway, back to the election for the sales taxes.  This matter will be coming back before the committee.  It is not over.  The people of Shawnee need to address this matter at a general election in November for two reasons:

1.  November elections get larger turnouts and more citizens of Shawnee could express their view, pro or con.
2.  A November ballot question would be at no charge to the city as opposed to $100,000 for a spring mail ballot.

If you don't believe me about Vaught's attitude and comments, then please listen to the audio of the meeting.  You can hear how he puts himself above all others, including the citizens of Shawnee.  The audio is available here:
http://www.cityofshawnee.org/WEB/ShawneeCMS.nsf/vwContent/Agendas?OpenDocument&navKey=Home

Go to the 12/3/13 committee meeting and click on "Listen to Audio of Meeting"
To save time you can scroll forward to approximately the 1 hr 25 min mark of the meeting to hear this subject matter, bypassing the other two items on that agenda.

Mayor to Appoint Uncle Alan to Planning Commission

I'm on the city's email list to get notifications of all meetings.  Needless to say, when the notice for this upcoming council meeting (12/9/13) came in, I clicked on the link to view the agenda with supporting documents.

I was not prepared for what was contained on the agenda.  Mayor Jeff Meyers is recommending that the council appoint Alan Willoughby (his uncle by marriage) to the planning commission.

Sound familiar?  Well, Mr. Willoughby has previously served on the planning commission and then left that position when he was appointed to fill the unexpired term of David Morris who had resigned from the city council.  Remember the brouhaha that caused?  The KOMA investigation?  And yes, the letter from the JoCo DA which was clearly a reprimand.  (Yes a reprimand, even though we have one councilmember who does not understand the meaning/definition of that word).  Then, when "Uncle Alan" ran for the council on his own, for a full term, he was defeated.

Anyway an opening on the planning commission has occurred because Stephanie Meyer has been appointed to the city council.  So now the mayor wants to appoint "Uncle Alan" to the planning commission, again.  Is this the consolation prize for losing the election for the council?  Is this designed to give him another line on his resumé should he decide to run for the council in the 2015 election?

Ironically, another individual submitted the documentation (10/31) to fill the seat on the planning commission prior to the date of "Uncle Alan's" submission (12/4).  An individual with an engineering background, who has served as a public works director and who might just provide some fresh insight into the items that come before that commission.

I remember a couple of years ago when council member Vaught had a hold put on some applications for the planning commission.  Methinks, not only a hold, but a thumbs down vote is in order for this one.

For those who don't believe this is happening please go here:

Vaught and His Hypocrisy

Something that happened at the meeting that selected Stephanie Meyer for the Ward III council seat reminded me of some of Jeff (The Arrogant One) Vaught's hypocrisy.

Previously, Vaught had been highly critical of and publicly excoriated a state representative for getting involved in Shawnee politics.  And he did that using the dais of the council chambers for his rant.  All that, even though the state rep is a Shawnee resident and has every right to speak out on what happens in the city.  http://shawneeray.blogspot.com/2012/04/after-smoke-has-cleared.html

But, when Vaught ran for reelection he had no problem touting the endorsement of US Sen Jerry Moran, a Hays, Kansas resident.

Also, Vaught's recent support of a new rental townhome project in western Shawnee (in Ward III) would appear to contradict his previous negative statements of the rights of those who rent.  Maybe we need to notify the folks who move into those units that their council member doesn't think they have a stake in Shawnee.

2015 City Elections

In approximately one year from now folks will be signing up to run for office in the city elections of April 2015.

That's not that far away.  Personally, I'd like to see more citizens involved with what happens on the local level to include voting in the city elections.

So, what do we have to look forward to?

Mayor:  Jeff Meters will be finishing his third term.  Add that to all the years he has served as a member of the council and he has definitely put in lots of time.  Look for him to retire from city politics.  What will happen?  See some comments below.

Ward I:  Jim Neighbor is up for reelection.  Most of the time one does not know what his position is on various issues until he votes.  It would be nice if he would state his position(s) ahead of time.

Ward II:  Long term council member Neal Sawyer is probably going to retire after this term, leaving his seat up for grabs.  It should be noted that Alan Willoughby, the mayor's uncle by marriage, has been attending most council and committee meetings.  Is he planning a run on his own?

Ward III:  Stephanie Meyer who was just appointed to fill an open seat will now have an opportunity to run for election for a full term on her own.  Jeff "The Arrogant One" Vaught is rumored to be considering a run for mayor.  Since his seat on the council is not up for reelection at this time, his council seat is safe if he loses the mayor's race.  If he runs for mayor, let's help him to keep his seat on the council by losing the mayoral election.

Ward IV:  Now this one is the fun one to watch.  Mickey Sandifer is up for reelection but it appears that he wants a shot at the mayor's office.  Since Mickey can only run for one office, he would have to run and win for mayor to stay in government.  Now, if he runs for mayor, that means that there is no incumbent running.  Guess what? Ward IV is getting a new resident.  None other than Dawn "Motormouth" Kuhn.  That is unless she runs under her soon to be new married name.  But, a motormouth is still a motormouth.  Kuhn getting elected to represent Ward IV would be just as much of a disaster as Jeff Vaught getting elected to be mayor.  Between Sandifer or Vaught, it's gottta be Sandifer...............unless somebody else pops in.

Stay involved Shawnee, the future of your city could depend on it.

Citizen Input at Public Meetings & Property Maintenance Code Enforcement

Tomorrow, Tuesday 11/5/13 the Council Committee will be reviewing Policy Statement 7 (PS-7).

This is the policy statement that governs the conduct of city council and council committee meetings.  It covers many aspect of the meetings to include citizen input.

Whether you have spoken out at any of these meetings in the past, plan on doing so in the future, or are just interested in how the process works this is a meeting to attend.  One never knows when they may have an issue to speak out about.  Just ask those who live in certain subdivisions that have recently had issues concerning public green spaces.  Think about the recent statements that the city may have to raise taxes in the not too distant future for infrastructure maintenance and repairs.  One never knows when one might want/need to speak at city hall.

The policy concerning Property Maintenance Code Enforcement (PS-55) is also going to be reviewed at this meeting.

The agenda with supporting documents is available at:

The meeting starts at city hall at 7PM, at 11110 Johnson Drive.

Vaught Just Doesn't Get It

At this past Monday's special council meeting to select a replacement for the open Ward III seat, councilmember Michelle Distler had an email from early August put on the overhead projector.
The email basically said that when Kuhn resigned from her Ward III seat, that Stephanie Meyer would be the individual selected to fill it.  The email went on to indicate which four sitting councilmembers would vote for Meyer:  Vaught, Sandifer, Neighbor and Sawyer.

Jeff Vaught labeled the email a rumor.

Well, let's see what happened:
1.  Kuhn resigned
2.  Stephanie Meyer was selected for the seat
3.  The councilmembers voting for Meyer were Vaught, Sandifer, Neighbor and Sawyer

Hmmmmmm........was the email a rumor?  Was it a coincidence?  Prophetic?  Psychic?  Clairvoyent?  Prescient? Or did word get out as to what the outcome would be?

When each of the candidates was asked if they thought the decision had been predetermined, their answers were interesting:

Sheahan emphasized the word "majority". He didn't  know if the "majority" had decided.
King said he didn't know for sure but maybe
Lauer said it was common knowledge the likelihood of which candidate it would be
Meyer said no

So they were all affirmative except Meyer.

Here's a thought.  Maybe it was predetermined. And maybe, just maybe, as a result of the KOMA investigation because of the prior appointment of Alan Willoughby (the mayor's uncle by marriage) that maybe certain individuals handled their collusion in a more surreptitious manner.

Who Would the Applicants Have Picked?

At Monday night's special council meeting to select an individual to fill the Ward III seat, the sitting councilmembers asked questions of the applicants.

One of the questions that Councilmember Michelle Distler asked of each of the applicants was if they were sitting on the council that night, which of the applicants would they pick.  Ironically, the responses were Jeff King and Jason Sheahan.  Nobody picked Stephanie Meyer, well, except Stephanie Meyer, and then she had to be reminded that the question was if she was already sitting on the council................interesting, eh?

Another Scripted Council Appointment?

First, before I comment on last night's council appointment of Stephanie Meyer to fill the vacancy in Ward III, I would like to wish Owen Donohoe a speedy full recovery.

Mr. Donohoe, one of the applicants for the position was taken yesterday afternoon to an ER for a pulmonary embolism and then transferred by ambulance to another facility.

OK, let's talk about Stephanie Meyer's appointment to the council.  What a farce.  A better script could not have been written by a Tony award winning Broadway playwright.

Councilmember Michelle Distler showed an email...............from early August, prior to Dawn Kuhn's resignation.  In that email it was mentioned that Kuhn was going to resign and that Stephanie Meyer was going to get the position.  The email even stated which four council members would vote for her.

Now, Jeff Vaught tried to discredit that email.. He even invoked the name of a former Shawnee resident as a possible generator of it.  Kind of like Obama blaming Bush for everything.  Anyway, the email was very accurate in describing what the outcome would be.  Coincidental?  Prophetic?

Keeping the above in mind makes me wonder about the question that Councilmember Dan Pflumm asked of each of the applicants.  He asked if they thought that the council should choose or if it should go to a special election.  Of the four applicants, three said the people should choose.  Mrs. Meyer was the only one who said that the current process was fine.  Contrary to what some have said, it could have gone to a special election.  The council would just have to fail to make an appointment for 60 days.  This would not require a change in the charter ordinance.  Just no action to appoint on the council's part.

So was Stephanie Meyer's appointment predetermined?  Do we even have to say, again, that the Oracle of Shawnee said the same thing, 16 days before she even applied for the position.

Councilmember Mike Kemmling expressed concern, and even brought up the JoCo DA's reprimand to the city concerning the previous appointment of Alan Willoughby (the mayor's uncle by marriage).  At that point Councilmember Vaught had to again show that his knowledge of the definition of basic words is very limited.  Vaught said the DA's letter was not a reprimand.  Huh?
OK......here is the link to the letter......
http://www.shawneefwiw.com/files/joco_da/2013-01-30-joco-da-shawnee-koma.pdf

Based on the definition, you decide for yourself if the letter was a reprimand or not:

n.
1. a severe rebuke, esp. a formal or official one.
v.t.
2. to reprove or rebuke severely.
[1630–40; < French réprimande, Middle French reprimend < Latin reprimenda that is to be repressed, neuter pl. ger. of reprimere to repress]
syn: reprimand, upbraid, admonish, censure mean to criticize or find fault with someone for behavior deemed reprehensible. reprimand implies a formal criticism, as by an official or person in authority: The lawyer was reprimanded by the judge. upbraid suggests relatively severe criticism, but of a less formal kind: The minister upbraided the parishioners for their poor church attendance. admonish refers to a more gentle warning or expression of disapproval, often including suggestions for improvement: I admonished the children to make less noise. censure suggests harsh, vehement criticism, often from an authoritative source: The legislators voted to censure their fellow senator

Vaught relies on his bombastic arrogance to make it seem like he knows what he is talking about.

And, the mayor had already announced that public input at this meeting would not be permitted.  Either there are some very accurate crystal balls out there or the outcome was preordained.  I have my opinion.  Do you have yours?

Who Will Be the New Ward III Councilperson?

It's coming down to the wire.  Monday night 10/28/13, at 6:30PM the Shawnee City Council will meet in special session to review the five applicants for the open position.

Here are the five applicants (listed alphabetically):

Owen Donohoe
Jeff King
Tony Lauer
Stephanie Meyer
Jason Sheahan

Based on qualifications, these are the two individuals that I feel are the most qualified:

1.  Owen Donohoe, who has served three terms as a state representative.  Mr. Donohoe's district included Ward III and he received thousands of votes from those folks. He has had an opportunity to work on legislation with a broader scope and involving larger fiscal responsibilities than what is normally seen at the city level.  As such, coupled with his having to work with individuals with opposing view points makes him the one applicant with the most experience for the position.

2.  Jeff King is a retired US Army Lt. Col.  As an engineer officer he held various positions of responsibility involving working with large numbers of military personnel and civilians.  Many of these positions also involved working with large budgetary figures, particularly in the public works area.  His assignment at Ft. Leavenworth with the "Lessons Learned" element speaks for itself.  The position basically called for him and his team to review situations that happened and reporting as to what was learned from those activities, the good and the bad.

With all that said, one must look at a post on this blog at
http://shawneeray.blogspot.com/2013/09/the-oracle-speaks-about-ward-three.html

In that post the Oracle of Shawnee predicted that Stephanie Meyer would get the nod.  What is ironic is that the post was approximately 16 days before she actually filed for the position.  It would be really interesting if the Oracle's prediction comes true.

Keep in mind that the last two council appointments raised some significant questions as to propriety. So much so, that the most recent one which involved the appointment of Alan Willoughby (the mayor's uncle by marriage) resulted in a KOMA investigation by the JoCo DA.

Also, please keep in mind that the mayor did not allow public input at that selection meeting and he is not allowing it at this one coming up.

Vaught Doesn't Tell it All

This was a classic "Arrogant Vaught" move.

At the last city council session Mike Kemmling (Ward II) suggested that the council not appoint a replacement for Dawn Kuhn, but to let it go to a special election.  This is an option under certain circumstances.

Jeff Vaught (Ward III) said the voters could always confirm or refute the council's appointment when the seat comes up at the next election cycle and if the appointee runs for a full term.  To back this up he cited two cases:  the first one he mentioned was when Kevin Tubbesing was appointed but then lost in the election to Michelle Distler for a full term.  The next one he mentioned was when Jim Neighbor was appointed and then won the election for a full term.

This would make some folks think that it has been 50/50.  What he failed to mention was the most recent appointment of Alan Willoughby (the mayor's uncle by marriage), who, when he ran for election was defeated by Mike Kemmling.  That means that out of the last 3 council appointments, 2 of them (67%) were "overturned" by the people when they came up for election for a full term.

Of course Vaught did not want to bring that one up since that was the appointment that caused the JoCo DA to investigate the mayor and certain councilmembers for a KOMA (Kansas Open Meetings Act) violation.

When Vaught makes statements with incomplete info it sounds like he is practicing for a run for mayor.

Just thinking, does the city manager's concern about bad or misinformation pertain to folks like Vaught (or even herself)?

Mayor Meyers Ignores His Oath of Office

Next Monday, October 28th 2013, the city council will interview the five individuals who have applied to fill the council vacancy created in Ward III by the resignation of Dawn Kuhn.  This will take place at a special council meeting, starting at 6:30PM

Mayor Meyers has already stated that he will NOT permit public comment at the special council meeting.  In August, as previously posted here, this was the mayor's response to my question as to whether or not public comment would be permitted:

Ray,

There will not be public input. I believe the Council will have the best and most information with the process to make a decision for the appointment. As you know, residents may always contact their representatives to give comment about individuals who apply.

Jeff

Look at what he says.  The "best and most information with the process"  Huh?  But this is the one that gets me:  "residents may always contact their representatives to give comment".  What is missing is that if a resident contacts their rep, that information is NOT made a part of the public record (minutes) of the meeting.  What public comment does the mayor not want to see "on the record"?

Why do I say he has ignored his oath of office?  I will restate section 3 of the Bill of Rights of the Kansas Constitution, a document the mayor has taken an oath to support.

3. Right of peaceable assembly; petition. The people have the right to assemble, in a peaceable manner, to consult for their common good, to instruct their representatives, and to petition the government, or any department thereof, for the redress of grievances.

I also sent an email to the 7 council members who would be doing the interviews as to their feelings about the mayor's decision NOT to allow public comment.

Three of our council members support public input (Pflumm, Kemmling and Distler).  One council member does not (Sawyer).  One takes both sides (Sandifer) and two lacked the intestinal fortitude and courtesy of even replying (Neighbor and Vaught).  Guess neither one of those two wanted their thoughts to be public.

The city council will meet in special session at 6:30PM on Monday 10/28/13 to interview the applicants for the seat.  If a decision is made that night, then that person will be sworn in and begin their term at the regular meeting which will follow at 7:30PM

Lawrence Journal World Sticks it to Shawnee

OK, let's identify the players:  The Lawrence Journal World owns the Shawnee Dispatch.

Ever since Rob Roberts left the Dispatch for the KC Business Journal there has been a void at the Dispatch.

First they send us Shawn Linenberger, but require him to divide his time between Shawnee and the paper in Tonganoxie.  Then, they bring in Jason Kendall and have him spending more time in Lawrence than in Shawnee.  Now, it is my understanding that Linenberger might be back.  But, will it be full time?

This lack of coverage by the supposedly local newspaper stinks.  Example being at last night's city council meeting.  Nobody was there to cover what turned out to be two extensive discussions.  One pertained to an agenda item:  the city's capital improvement plan for 2014-2019.  The other was  a non agenda item:  whether the council should defer the choice of Kuhn's replacement rather than the council making the selection.

Now, at this point, I am NOT going to discuss the items above as to what my opinions are of them.  What I am going to say is that the Journal World has deprived the citizens of Shawnee the opportunity to read about what happened and then to make up their own minds.  This is not the first time that the local paper has been bereft of true local coverage, post-Roberts.

Here's the kicker.  The City of Shawnee has selected the Dispatch as the publication of record.  That means that all notices that are required to be published are done so in the Dispatch.  Hey, that's our money, and our citizens are not being kept informed about what is happening.

Stopping a Cat Fight???

At the 10/8/13 council committee meetingDr. Kemmling asks for clarification (calmly) on an item.

The chair (Jim Neighbor) recognizes Dawn Kuhn who belittles Dr Kemmling.  Before recognizing Dr Kemmling again, Neighbor says that we are not going to have a cat fight.  Typical.......Kuhn is allowed to belittle folks and then the concerns start that someone might just come back on her.  BTW, Dr. Kemmling's response was very calm.  If you don't want a cat fight, shut the cat up.  But that has been par for the course.  She has been allowed to say whatever she wants, whenever she wants.

Thank heaven her resignation is effective with the end of the council meeting on 10/14/13.  We won't have to put up with her cattiness, her attempts at belittling people, and most importantly, her long winded diatribes.  If a harridan ever sat on the Shawnee City Council, it has been Dawn Kuhn.

Oh, the city has announced that her going away party is open to the public.  Methinks some folks might want to show up just to wish her good riddance.  Info at http://www.cityofshawnee.org/WEB/ShawneeCMS.nsf/vwNews/17083007BC863D4A86257BF80051EDED?OpenDocument

Citizen Suggestion Gets Zero Response

Guess what?  A suggestion I submitted to the city has gotten absolutely no response whatsoever.  The response should have come from either the city manager or the city clerk, but primarily the city manager.

On 9/15/13 I submitted a suggestion to the city concerning the info submitted by the applicants for the soon to be vacated Ward III council seat.  See post at http://www.shawneeray.blogspot.com/2013/09/info-on-applicants-for-ward-iii-position.html

The idea was to save time and money for the city, and to make it easier for folks to obtain the info on the applicants so they could review it and submit comments to their council persons.  This is especially important since the mayor has already said that there would be no public input at the 10/28/13 special council meeting.

What was the suggestion?  To put the applicants' info on line so folks could download them.  That would eliminate having to process KORA requests.  Well guess what?  Not only has the suggestion not been implemented, but I never got a reply saying it was a good idea, a bad idea or even a courteous "thanks for the idea".  I bet if certain other folks had submitted the idea it would have been implemented.

Anyway, I did submit KORA requests, and, as usual, our city clerk handled them in a most expeditious manner.  For that I am thankful.

Questioning Elected Officials

Sitting here, I am reminded of Mayor Jeff Meyers' comments in the Shawnee Dispatch about some folks asking too many questions.

I'm reminded how some members of the city council have complained about citizens asking questions.  And even get offended that the questions get asked.

I'm reminded how some local elected officials fail to respond with specific answers to specific, direct questions.

I'm reminded how the city manager dances around certain questions, or refuses to answer altogether.

And then I'm reminded about a scene from the movie "The American President".  In this scene, the Michael J Fox character who is on the President's staff, questions the President.  The Martin Sheen character, then takes the Fox character to task for questioning the President.  This is the result:

A. J. MacInerney: The President doesn't answer to you, Lewis!

Lewis Rothschild: Oh, yes he does A.J. I'm a citizen, this is my President. And in this country it is not only permissible to question our leaders it's our responsibility!

Going forward I will continue to question those items that I feel need questioning.  I will continue to point out the hypocrisy of those officials who refuse to provide specific answers to specific questions.  And, the City of Shawnee is hereby put on notice that if the person that gets the $70K per year job as PIO becomes a puppet for the city and fails to respond to direct queries, that person will be held accountable.  That is our money, and we deserve to have it spent to properly inform and respond to us and not be a propaganda generator.

So, let's reiterate "Lewis Rothschild's" comment:   And in this country it is not only permissible to question our leaders it's our responsibility!   And we better start getting real answers.

Four Have Now Filed

Another individual has filed for the soon to be vacated Ward III council seat.

That individual is Jeff King.

Wednesday, October 02, 2013

Three Have Filed for Ward III Seat

As of yesterday, three individuals have filed for the Ward III seat which is soon to be vacant because of the resignation of Dawn Kuhn.

They are:  Jason Sheahan, Stephanie Meyer and Owen Donohoe.

Donohoe was a three term state representative that represented Ward III and a portion of Ward I.  He is definitely a man who knows what the folks in Ward III want from a representative.

Shawnee, Open Wide and say Ahhhhhhhhhhh!!!

We are not talking about your throat for a doctor to check for an infection. We are talking about your wallets. Yepper, it's coming. What is it? Tax increases.

Let's start with this article regarding a Sept. 17, 2013 council committee meeting in the Shawnee Dispatch. Please read it, along with the other links posted here. I will have some additional comments at the end of this post.
http://www.shawneedispatch.com/news/2013/sep/18/kendall-higher-taxes-coming-soon-shawnee/

Back in April, City Manger Gonzales was so happy about not having to raise taxes for the 2014 budget. Notice though how she doesn't really mention what is in store for 2015 and beyond. Didn't she see it coming? Was the info not being given to the citizens of Shawnee? Was she purposely omitting that.  Don't believe me? Please read this article:
http://www.shawneedispatch.com/news/2013/apr/23/city-manager-2014-budget-wont-require-tax-increase/

Then the City of Olathe indicated that they would be looking at tax increases. No kidding, and I wondered if the same would be happening to Shawnee. That can be read here:
http://www.shawneeray.blogspot.com/2013/07/will-shawnee-follow-olathe.html#links

And then , wonder of wonders, Mayor Jeff Meyers plants the seed for a tax increase.
http://www.shawneeray.blogspot.com/2013/07/is-mayor-planting-seed-for-tax-increases.html#links

Now, the Sept 17th committee meeting was one of the few I have missed. I haven't seen the minutes , as they are not posted yet, but it is my understanding that one of the council members (from Ward III, Vaught) had indicated something to the effect that if there was a tax increase then funds normally allocated for street repairs should go to other areas.

Whoooops. If we need a tax increase for street repairs, then let's also keep any "normal" allocations for that purpose. And, let's cut out the nonsense with the $3 million that we get from Deffenbaugh and apply all of it to infrastructure updates/maintenance.  This as opposed to the current plan of 50/50 with streets and eco development. That could reduce the tax increases and maybe allow for them to have a specific end date, or project to revert back after a certain time frame.

As I said above, "Shawnee, Open Wide and say Ahhhhhhh"

KC Star Comments on Council Selection Process

Last week, the KC Star ran a story about the upcoming selection process to fill the soon to be vacant Ward III seat.

I think it's a pretty interesting story, especially since it's not from anyone with an interest in the outcome.

Read it here at http://www.kansascity.com/2013/09/17/4488440/questions-resurface-as-shawnee.html

Why Do We Get Inflated New Job Projections?

In the past couple of months we have been given, what I feel, are inflated job projection numbers for two development projects.  This is usually done when the city council has to look and vote on various financial packages for the developments.

Holiday Inn Express

The city council was told that this 112 room, mid-priced, limited service hotel would generate 70 new employees.  One of the council members, Michelle Distler questioned this figure, for various reasons.  Her figure of approximately 25 employees makes more sense.

Those of us who have either stayed at, or done business with these types of hotels know that the figure of approximately 25 employees makes more sense.  Let's break it down.

Maintenance: 2, if they are lucky 3
Housekeeping:  8-10
Front end:  8-10  This would include a GM, ass't GM, front desk clerks during the day and a night clerk/auditor.  Unless they have a large number of meeting rooms (which they usually don't) the GM or the assistant would also function as sales manager.  Keeping in mind their function would be to get businesses to have folks stay there and use the meeting rooms.  With no kitchen, all food would be catered in.  Morning continental breakfasts would be handled by one of the front desk personnel.

Do we need this hotel?  Yes   Would 25 new jobs benefit the city?  Yes  Do we need the over inflated potential new job figures?  No

West Link Business Park

OK, the first building is going in.  It will be 170,000 sq ft.  That's a nice size.  The projected new jobs figure was stated as 250.  Who is kidding who?  We have all seen buildings like this in other business parks.  They are usually subdivided into smaller units.  Believe the builder even said no unit would be less than 20,000 sq ft.  Where are the 250 potential new jobs coming from?  You would need one heck of a manufacturing company, taking the whole building, and possibly running multiple shifts.  Or, would dividing the building into smaller units, the kind we've seen elsewhere, that have warehouse space (and workers) and some front office personnel be more plausible?  These types of facilities then usually employ between 5-8 people.  That means we would be looking at between 40-60 new jobs.  It is my understanding that the local chamber was given a presentation about this and that the dividing up of the building was a key factor.  Also, look at the artist's rendition of what the building would look like at http://www.shawneedispatch.com/photos/2013/jul/02/52464/
Are there even enough parking places planned for 250 or are they planned for the subdividing of the building?

Do we need this development?  Yes  Would 40-50 new jobs benefit the city?  Yes  Do we need the over inflated potential new job figures?  No

Going forward, I will have no problems in labeling over inflated potential new jobs as BS.

The city manager has expressed concern that local bloggers and local media sometimes provide bad or misinformation.  Maybe, just maybe, she should look at the information that the SEDC provides to the city council when it comes to info that the council relies on to approve financial incentives.

Let's Party, Or, Are We Inivted?

A new precedent was set when Uncle Alan Willoughby's appointed term to the council ended.  A bye-bye reception was held at city hall.

In an email dated August 8th from city manager Carol Gonzales to Jim Neighbor in which Dawn Kuhn's upcoming resignation was discussed it was stated by the city manager "We will probably plan a reception to thank Dawn, before the meeting on the 14th, similar to what we did for Alan."

Since this reception will probably be held in city hall, (most likely in the conference room across from the planning department), and the costs covered with city (read that as taxpayer) funds, maybe the citizens of Shawnee should also be invited.  Bet there are a lot of people who would attend just to see that Kuhn really is going bye-bye, and happy about it.  The council will probably be a better place when this classic harridan departs.

Keep that date in mind, Monday 10/14, probably around 6:30PM. (Correction originally shown as 8/14)

Info on Applicants for Ward III Position

I have sent the following email to the city clerk, with copies to the governing body and the city manager:

In response to a question I sent to members of the council, part of Neal Sawyer’s is quoted below:

“I believe that we should conduct the interview process without public comment. I believe that the people that are interested in the appointment will contact the council members prior to the special meeting to let them know if they have concerns about a candidate or would like for them to support a candidate. That way the council members have time to carefully consider any citizen comments rather than hear them only minutes before a vote is cast.”

There is one minor problem with the above.  Access to the information, i.e.cover letter, resumé, and other items required to be submitted, apparently is only available right now by KORA request.

I know that you are very conscientious about responding to KORA requests for this type of information.  But, wouldn’t it save time, and money if a link was created on the city’s web page so that citizens could download the info?

The only individual who has applied so far (according to the city’s web site) is a Jason Sheahan, and that was a little over a week ago, and there is no link to the info.

I am suggesting the link for the applicants’ info be created within 24-48 hours of their submission.  This time frame becomes important especially if individuals wait until near closing date, since the meeting will be held 6 days after the closing date.  This would then allow citizens time to research the qualifications of the candidates, and submit timely comments to the members of the council as Neal Sawyer suggests.

Neal Sawyer Responds

Reference is made to the previous post concerning who did or did not respond to my question concerning public input for the upcoming special council meeting (10/28/13).  Councilmember Neal Sawyer responded last night:

Neal Sawyer, Ward II

At the state and county levels of grovernment when someone resigns or leaves their office, the precinct committee people of the party have a meeting to pick the successor.   Those meetings can only be attended by precinct committee people of that district and the only opportunity for a citizen to make comments is to find out who their precinct committee people are before the meeting and talk with them.

I went back and looked at other appointments that have been made since 1998 and if commits were taken.   Please see below.

7/8/1998      Ward 2  Mayor Allen                Roche was appointed             No Public Comment

1/14/2002   Ward 2  Mayor Allen                 Sawyer was appointed            No Public Comment

5/4/2004      Ward 3  Mayor Meyers           Novosel was appointed             Public Comment

2/7/2005     Ward 4   Mayor Meyers           Tubbesing was appointed          No Public Comment
5/10/2012  Ward 3  Mayor Meyers             Neighbor was appointed             Public Comment
7/9/2012     Ward 2  Mayor Meyers             Willoughby was appointed        No Public Comment

I believe that we should conduct the interview process without public comment. I believe that the people that are interested in the appointment will contact the council members prior to the special meeting to let them know if they have concerns about a candidate or would like for them to support a candidate. That way the council members have time to carefully consider any citizen comments rather than hear them only minutes before a vote is cast.

My comments about the above:  City government is not as large as county or state and is closer to the people.  As such, I'll disagree with Neal, and feel the comments of the people should be live and on the record.

Which Council Members Support Citizen Input?

On October 28th, 2013 seven members of the city council will select an individual to replace Dawn Kuhn who has resigned effective October 14th, 2013.

Based on information contained on the city's web site, it did not appear that there was going to be time allocated for citizen input at that meeting.  On August 28th I inquired of Mayor Jeff Meyers if public input would be permitted.  The mayor responded that no public input would be permitted at that meeting.  Full texts of both emails can be seen by scrolling down here.

So, last weekend I emailed the seven council members with the following:

In reply to a question about the upcoming meeting of 10/28/13 to select a replacement for Councilmember Kuhn, Mayor Jeff Meyers has said there will be no public input permitted.

Do you agree or disagree with the Mayor regarding public input at that meeting?

Thank you,

Here are the replies (and also a list of those who did not reply)

Dan Pflumm, Ward I

I disagree with the Mayor I believe the City of Shawnee should encourage public input, especially after what has transpired in previous appointments.

Mike Kemmling, Ward II

Disagree.  I will be sending him an email expressing my opinion.  Thanks for being pro-active in this.

Michelle Distler, Ward IV

We are not autonomous. Any decision that impacts the citizenry should involve them and allow for input.

The above three council members apparently believe that the citizens of Shawnee deserve a say at that meeting.

Mickey Sandifer, Ward IV

As the Mayor and I do not always agree on issues.  I have asked in the past if the Council had a say in how the City Council meeting was operating.  I was told that the Mayor makes the decisions on whether or not someone can address the Council. In this case I do not agree,  although I do respect the office of the Mayor I will not challenge the Mayors authority

Looks like Mickey's answer is a breakfast food, a waffle.  He was elected to represent the people, not the mayor.

The following three council members have NOT repliedJim Neighbor, Ward I, Neal Sawyer, Ward II and Jeff Vaught, Ward III.

I did not expect a reply from Neighbor.  He has shown a proclivity to avoid direct answers to direct questions in the past, and probably did not get permission from his puppetmaster.  It was a surprise that Sawyer did not respond.  I really thought he would.

Now we come to Vaught.  He has exhibited many totalitarian tendencies in the past, including being non-responsive to inquiries.  What is ironic about him, is that in the last campaign one of the labels that he gave himself was that of a patriot.  A patriot would support the people.  What has he ever done that was patriotic? (Another question that I'd like to see him answer, but he won't.)  I don't think he ever even served his country.  Anyway, IMHO, as a patriot, he is a fraud.
